    Background: IN THE MALAYSIAN STATE OF SARAWAK, THE GOVERNMENT OF DATO STEPHEN NINGKAN HAS BEEN VOTED OUT OF OFFICE BY THE COUNCIL NEGRI - THE STATE ASSEMBLY. THE NEW CHIEF MINISTER, PENGHULU TAWI SLI, WAS SWORN-IN YESTERDAY (SATURDAY) IN KUCHING, THE STATE CAPITAL.

    THE COUNCIL NEGRI MET LAST FRIDAY (23 SEPTEMBER) UNDER ORDERS FROM THE STATE GOVERNOR, TUN ABANG HAJI OPENG, WHO HAD BEEN GIVEN SPECIAL POWERS BY THE MALAYSIAN CABINET AFTER AN EMERGENCY MEETING IN KUALA LUMPUR.

    SARAWAK HAS BEEN IN A STATE OF CRISIS SINCE LAST JUNE WHEN THE FEDERAL GOVERNMENT DISMISSED DATO NINGKAN. A HIGH COURT SUIT THIS MONTH REVERSED THE ACTION AND DATO NINGKAN RESUMED HIS OFFICE AS CHIEF MINISTER.

    AT THE COUNCIL NEGRI MEETING, ALL 25 MEMBERS OF THE ALLIANCE GROUP LED BY PENGHULU SLI VOTED FOR THE MOTION OF NO CONFIDENCE AGAINST DATO NINGKAN, WHO, WITH HIS SUPPORTERS, HAD BOYCOTTED THE MEETING. THE LEFT-WING OPPOSITION SARAWAK UNITED PEOPLE'S PARTY, WHICH HAS DECIDED TO JOIN FORCES WITH DATO NINGKAN'S SARAWAK NATIONAL PARTY, ALSO BOYCOTTED THE MEETING. IN THE VOTING ON FRIDAY, THREE EX-OFFICIO MEMBERS ABSTAINED, AND ONE INDEPENDENT MEMBER WALKED OUT WITHOUT VOTING.

    AT A NEWS CONFERENCE AFTER HIS DISMISSAL, DATO NINGKAN DENOUNCED THE COUNCIL'S PROCEEDINGS AS UNCONSTITUTIONAL AND HINTED THAT HE MIGHT MAKE A DIRECT APPEAL TO BRITAIN TO INTERVENE IN THE DISPUTE. THIS WOULD MEAN INVOKING THE INTER-GOVERNMENTAL AGREEMENT OF 1962 BETWEEN BRITAIN AND MALAYSIA WHICH LED TO SARAWAK'S INCORPORATION IN MALAYSIA.
