    JURY SELECTION BEGAN MONDAY - 10/26/59 - IN CASE OF TWENTY-TWO MEN ACCUSED OF CONSPIRING TO OBSTRUCT JUSTICE BY CONCEALING FROM A GRAND JURY THE TRUE NATURE OF THE 1957 APALACHIN MEETING.

    TRIAL OF A TWENTY-THIRD, JOSEPH BONANNO OF TUSCON, ARIZONA (CQ) - WAS SEPARATED FROM THE OTHER, DUE TO A HEART ATTACK, WHEN COURT CONVENED AT 10:30 A.M., JUDGE KAUFMAN WAS TOLD OF BONANNO'S HEART ATTACK ON SUNDAY, 10/25/59 - WHILE VISITING FRIENDS IN BROOKLYN.... THAT HE WAS RUSHED TO ST. CATHERINE'S HOSPITAL AND PLACED IN AN OXYGEN TENT.

    JURY SELECTION POSTPONED UNTIL 2:30 P.M., SO COURT PHYSICIAN COULD EXAMINE BONANNO, AGE 55; DR. SIMON DAUB, HEAD OF CARDIOLOGY DEPARTMENT AT MOUNT SINAL HOSPITAL, WHO WAS SUGGESTED BY MILTON R. WESSEL CHIEF PROSECUTOR AND SPECIAL ASSISTANT TO THE U.S. ATTORNEY GENERAL. DR. DAUB REPORTED LATER BONANNO, WHO HAS A CARDIAC HISTORY, SUFFERED AN "ANGINA ATTACK", WHICH PROMPTED JUDGE KAUFMAN TO GRANT BONANNO A LATER TRIAL.

    AT AFTERNOON SESSION 214 PROSPECTIVE JURORS WERE JAMMED INTO THE LARGEST COURT ROOM IN U.S. COURT HOUSE AT FOLEY SQUARE. OF THE 29 (twenty-nine) PROSPECTIVE JURORS CALLED BEFORE JUDGE KAUFMAN, EIGHT WERE EXCUSED, SAYING THEY HAD BEEN PREJUDICED BY NEWS. PAPER AND TELEVISION ACCOUNTS - TWO EXCUSED FOR ECONOMIC HARDSHIP AND SEVEN WERE CHALLENGED BY THE DEFENSE. THE TWELFTH PERSON EXAMINED, A WOMAN, SAID SHE HAD NEVER READ ANYTHING ABOUT THE CASE. THE SELECTION OF THE JURY WILL CONTINUE 10/27/59.

    WHILE WAITING FOR DR. DAUB'S REPORT ON BONANNO, THE DEFENSE UNSUCCESSFULLY ARGUED A MOTION FOR DISMISSAL OF THE INDICTMENT.

    HENRY G. SINGER ARGUED CHARGES WERE INCONSISTENT WITH THE ALLEGATIONS IN THE INDICTMENT, SAYING CHARGES DID NOT AMOUNT TO "AN INDICTMENT FOUND BY THE GRAND JURY, BUT ONE DREAMED UP BY THE PROSECUTION." THE APALACHIN GATHERING TOOK PLACE NOV. 14, 1957, AT THE UPSTATE NEW YORK HOME OF JOSEPH BARBARA, SR. SIXTY_THREE MEN, SO ME OF WHOM HAD UNDERWORLD CONNECTION, ATTENDED THE MEETING, WHICH WAS RAIDED BY STATE POLICEMEN. ALL MEN WERE RELEASED AFTER QUESTIONING.

    THE GOVERNMENT HAS CHARGED THAT THE CONSPIRACY BEGAN ON NOV. 14, 1957, AND RESULTED IN FALSE AND EVASIVE TESTIMONY BEFORE A FEDERAL GRAND JURY.
