    Background: THE WORLD COURT IN THE HAGUE TODAY (MONDAY) REJECTED A CHALLENGE TO SOUTH AFRICA'S ADMINISTRATION OF THE FORMER GERMAN COLONY OF SOUTH WEST AFRICA. THE DECISION OF THE HIGHEST INTERNATIONAL TRIBUNAL WAS ARRIVED AT BY THE SINGLES CASTING VOTE OF ITS CHAIRMAN.

    THE WORLD COURT'S RULING WAS ON A COMPLAINT BY ETHIOPIA AND LIBERIA, ACTING ON BEHALF OF ALL AFRICAN STATE, THAT SOUTH AFRICA HAD VIOLATED ITS MANDATE - GIVEN TO IT BY THE LEAGUE OF NATIONS 46 YEARS AGO - BY INTRODUCING APARTHEID AND FAILING TO PROMOTE THE INTEREST OF THE INHABITANTS OF SOUTH WEST AFRICA.

    AFTER NEARLY SIX YEARS OF DELIBERATIONS, THE COURT REJECTED THE COMPLAINTS ON THE GROUNDS THAT ETHIOPIA AND LIBERIA HAD FAILED TO ESTABLISH ANY LEGAL RIGHT OR INTEREST IN THE TERRITORY'S ADMINISTRATION. IT DID NOT RULE ON THE APARTHEID ISSUE.

    THE COURT WAS AT FIRST SPLIT 7 - 7 ON ITS RULING, BUT THE AUSTRALIAN PRESIDENT, SIR PERCH SPENDER, THREW HIS CASTING VOTE IN FAVOUR OF REJECTING THE COMPLAINTS.

    LATER, DR. HENDRIK VERWOERD, THE SOUTH AFRICAN PRIME MINISTER, HAILED THE DECISION AS A MAJOR VICTORY AND SAID THAT IT SHOWED THAT ATTEMPTS TO USE THE COURT'S MACHINERY AS A BASIS FOR AN ATTACK ON HIS COUNTRY IN THE UNITED NATIONS SECURITY COUNCIL HAD FAILED.

    AFRICAN COUNTRIES VIEWED THE RULING WITH SOME SURPRISE AND DISAPPOINTMENT. MR. MARTINUS JOHNSON, LIBERIA'S ACTING CHIEF DELEGATE TO THE UNITED NATIONS, CALLED THE JUDGEMENT "SHOCKING". IN ADDIS ABABA, THE REACTION OF THE GOVERNMENT WAS ONE OF "DEEP REGRET".
