Background: Army Specialist Third Class, William S. Girard on Tuesday failed in his attempt to have his manslaughter case dismissed from the Japanese Courts.

Girard is charged by the Japanese with the manslaughter of Mrs Naka Sakai.

Girard, who had been accompanied to the court by his personal legal adviser, Major Stanley Levin, and an interpreter, took the stand to deny the charges, after he had heard the prosecution case that he fired "two or three times at other Japanese" before he killed Mrs Sakai.

Itsuro Hayashi is leading for the defence.

The trial has excited world interest. For the first day's hearing over 400 Japanese spectators queue all night outside the Maebashi District Court at Maebashi City. Only 35 tickets are available and are issued on the basis of a lottery.

Among those present at the court on the first day were Shigemitsu Akanekubo, Socialist party member of the Diet and the man who brought the Girard shooting out into the open; former U.S. judge William Clark; Kayoko Sakai, the second daughter of the deceased.

The case appears to have been received with mixed feelings in the country. On the one hand were anti-American placards urging that the trial should not be conducted according to the wishes of the United States; and on the other, handbills were being passed round by a member of the headquarters of Appeal for Reduction in Girard's punishment.

At the close of the day's sitting the prisoner was taken to Camp Drew -where he is stationed pending the result of the trial - to await the next hearing to be held at the Maebashi Court on September 6th.
